The AI Blind Spot in Solo and Small Law Firms: Ethical Risks Hiding in Plain Sight

Many solo and small law firms assume AI governance is something only large firms need. It is not. AI is already showing up in everyday practice through legal research, drafting, email, intake, billing, administrative workflows, and staff or contractor use—often without clear guardrails, training, or supervision. This program examines those risks through the framework of ABA Formal Opinion 512 and the ABA Model Rules of Professional Conduct, including Rules 1.1, 1.3, 1.4, 1.5, 1.6, 3.1, 3.3, 5.1, 5.3, and 8.4(c). Attendees will learn how seemingly casual or behind-the-scenes AI use can create problems involving competence, diligence, confidentiality, client communication, fee reasonableness, supervision, unreliable output, candor to the tribunal, and misrepresentation. The program also offers practical guidance on AI policies, staff training, vendor due diligence, human review, and everyday risk controls that are realistic for solo and small firm practice.

  1. Identify the most common AI-related ethical risks facing solo and small law firms.
  2. Apply ABA Formal Opinion 512 and key ABA Model Rules to everyday AI use in practice.
  3. Recognize how AI use can affect competence, diligence, confidentiality, communication, fees, supervision, and litigation duties.
  4. Implement practical safeguards, including policies, training, vendor review, and human verification of AI output.
